Power of Attorney (POA) Kya Hoti Hai?

Power of Attorney ek legal document hai jiske zariye aap (Principal) kisi doosre vyakti (Agent/Attorney) ko aapki taraf se kanooni ya financial kaam karne ka adhikar dete hain. Yeh tab zaroori hoti hai jab aap NRI hon, beemar hon, ya physically kaam nahi kar sakte hon.

Types of POA

General Power of Attorney (GPA): Broad authority — property sell karna, bank transactions, legal proceedings, all types of acts. Highly useful for NRIs.
Special Power of Attorney (SPA): Limited to specific task — e.g., "Sell only this specific property" or "Represent in XYZ court case only". Safer option.
Durable POA: Remains valid even if Principal becomes mentally incapacitated. Used for elderly care planning.

Documents Required

  • Aadhaar Card of both Principal and Agent
  • PAN Card of both
  • Passport Size Photos: 2 each
  • Property Documents (if property-related POA)
  • Non-Judicial Stamp Paper (value depends on state and POA type — Rs. 100 to Rs. 500)

POA Registration Process

  1. Vakeel ya legal expert se POA draft karwayein
  2. Stamp paper par print/type karwayein
  3. Both parties Sub-Registrar Office mein jaayein with original IDs and 2 witnesses
  4. Sub-Registrar registration karega — Registration Fee: Rs. 100 to Rs. 500
  5. Registered POA ko safe rakhein — certified copy bhi lein

POA for NRI (From Abroad)

NRI ko India mein kaam ke liye India aane ki zaroorat nahi — woh apne desh mein Indian Embassy / Consulate mein jaayein, wahan POA execute karein (notarize + apostille), phir India bhejein. India mein agent Sub-Registrar par adjudicate karwayega.
